In Islam, women are given just as much importance as the men. In Islamic culture, men and women are two important parts of society and they should be treated equally and given equal rights as well. However, many people have misconceptions regarding the rights of women in Islam. The purpose of this article is to highlight the basic rights that women hold in Islam regarding the important issue of divorce. Nowadays, as Muslims follow varying Islamic schools of thought, the situations regarding divorce may be different. How divorce is treated also depends on a variety factors such as cultural practices, etc.
At this point, it is very important for all people to understand that the cultural traditions regarding personal belief and the religion of Islam are two different things. Major problems arise when people mix their cultural traditions with the teachings of Islam. As Muslims are highly influenced by their cultural backgrounds, this sometimes makes it difficult for attorneys to understand Islam’s teachings and they often make mistakes when interpreting matters and practices associated with Islam. Islam has followers all over the world, and therefore it is a tremendously diverse religion when it comes to the various cultures involved. Muslims in Africa, Asia, Europe or America all have different tribal and national backgrounds.
Before Islam, like many other aspects of married life, divorce also existed. With the advent of Islam, the procedure of divorce began to favor women. Before Islam, the right to share property was not given to women, and because of this, when divorce occurred the property of the woman involved was distributed. Now, in contrast to that, Islam has given rights to women to take a share in her property, and if any woman has earned her possessions, they will remain hers, under her possession, after the divorce.
In Islam, the waiting period for women after a divorce is known as Iddah. During this period, women are not allowed to remarry. The reason behind this waiting period is to verify whether the woman is pregnant, so that proper knowledge about the father of the baby can be attained, and thus, after the birth, proper documentation regarding the child can be made. The woman is more secure in the Islam religion because she receives much more respect and love.
Divorce is not common in Islamic society due to the teachings of Islam, but due to modernization, the divorce rate is very high in Europe. Pre-marriage relations are common in European countries and women prefer to live with their boyfriends even after marriage. Such conditions result in conflicts and divorce. There are several other causes of divorce such as a lack of understanding and patience. Couples should take the time to understand each other. Financial stress also plays a very important role in this case.
