on Thursday, May 9, 2013

Son of Muammar Gaddafi will appear in front of the court for trying to escape from jail. Saif –Al- Islam is accused of conspiracy for escaping from prison. The Libyan court has called Saif –Al- Islam to appear in front of the court to have an explanation for what he is accused of.

After Muammar Gaddafi government was over his son Saif –Al- Islam was arrested in November 2011 by Libyan police and then he was sent to jail. Recently Saif –Al- Islam was found doing suspicious activities in jail that suddenly resulted in a failed attempt to escape from the jail.

Saif –Al- Islam was held in Zintan jail when tried to escape. More importantly, it is said that his lawyer Malinda Taylor was also involved in the conspiracy. Malinda was also kept in detention by the Libyan government last summer as there were many allegations about Malinda as being involved in the activities with Saif –Al- Islam.

Some rebels tried almost everything to get Saif –Al- Islam out of jail. but these rebels failed as there are tough security measures taken by the Libyian government against Saif –Al- Islam. Since 2011, it is only the second time Saif –Al- Islam was presented to the court because there are a number of allegations on Saif –Al- Islam.

There are a number of allegations on Saif –Al- Islam which includes that he was also involved in war crimes. All of these allegations on Saif –Al- Islam were made by the Libyan government and the International Criminal Council. Now, Saif –Al- Islam will have to face the allegations from both parties. On the second hearing last Thursday, Saif –Al- Islam’s lawyer said in a statement that all of the allegations that have been made by the government and the ICC are pointless. John Jones added that his client Saif –Al- Islam was kept in detention in Libya’s Guantánamo Bay without any legal process. He also said that he was not convinced with the procedure that was being adopted by the court.

After 17 months detention in jail in Guantánamo Bay, when he was presented in front of the court, he seemed very weak physically but he kept on smiling whrn looking at the journalists sitting in the court. There are two other lawyers that were appointed by the court that would represent Saif –Al- Islam. The court adjourned the case till September.

There have been conflicts between the ICC and the Libyan government about who should be holding the rights for custody of Gaddafi. It’s not been yet decided by the ICC whether they should be backing up the Libyan government plans. Saif –Al- Islam lawyer and Libya’s former intelligence chief Abdullah have been jointly charged.
